A panel of the U.S. Court of Appeals for the Second Circuit has agreed to rehear arguments in a case that revived a state lawsuit targeting anti-abortion protesters outside of a Queens medical clinic, vacating an earlier opinion that ruled against the demonstrators.

The move, announced Tuesday, could jeopardize New York Attorney General Letitia James’ ongoing efforts to sue the demonstrators in federal court for allegedly harassing and intimidating patients during weekly protests that date back to 2012.
