Arguments have been rescheduled to Tuesday in a lawsuit from multiple state appellate judges who are fighting the state court system’s decision to effectively force them off the bench because of a budget cut.

Top court system officials sparked backlash last fall when they decided deny certification to 46 older judges at the trial and appellate level, effectively removing them from the roster of judges. Court officials said the austerity measure was necessary as the system faced a 10% budget cut from Gov. Andrew Cuomo.
