With the end of the Trump regime in sight, those committed to civil rights and civil liberties can be forgiven for stepping back for a moment and taking pleasure in some of the less weighty constitutional controversies of our time. And few things are as pleasurable as lawsuits brought by ultra-self-righteous figures who have been exposed as the hypocrites they so often turn out to be. Exhibit A of the moment is Jerry Falwell Jr., an ardent Trump supporter who until recently headed the ultra-moralistic Liberty University in Lynchburg, Virginia.

For those who may have fallen behind in their tabloid reading, Falwell was at the center of an unorthodox series of events this summer featuring a provocative photo of him and a woman not his wife, his disclosure that his wife had had an affair with a pool boy and the pool boy’s claim Falwell was an active observer of sex between the two over the six-year affair, and Falwell resigning from Liberty and reportedly walking away with a $10.5 million severance. Apparently not satisfied with this resolution, Falwell sued Liberty on October 28, alleging defamation and breach of his employment contract. According to Falwell’s complaint, Liberty’s defamation offense arose from the university having stated that Falwell had engaged in “disobedient” behavior “in secret” that was “shameful” and a “sin.” Wonderfully, the complaint charges that “Liberty’s actions are antithetical to the teachings of Christ.”
