A Suffolk County Supreme Court judge has set a Dec. 7 hearing date and granted expedited discovery in the older Appellate Division justices’ lawsuit against the state court system that claims their termination, via a court system decision not to recertify them to the bench, violates the law.
As part of Supreme Court Justice Paul Baisley Jr.’s order, which came in response to the four appellate justices filing an order to show cause aimed at speeding up their lawsuit, Baisley has directed state Chief Judge Janet DiFiore to be deposed Nov. 16 and Chief Administrative Judge Lawrence Marks to be deposed Nov. 18.
