Manhattan District Attorney Cyrus Vance Jr. on Thursday asked the U.S. Court of Appeals for the Second Circuit to deny President Donald Trump’s motion for an emergency stay of the grand jury subpoena for Trump’s financial records, arguing that Trump failed to state a claim in his most recent complaint.

Senior U.S. District Judge Victor Marrero of the Southern District of New York allowed Trump to file a second amended complaint after the U.S. Supreme Court in July ruled against his claims of absolute presidential immunity from state criminal procedure. But in an Aug. 20 opinion, Marrero found that Trump relied “upon too many unreasonable inferences” in his renewed argument against the subpoena.
