A Columbia University custodian’s claims of discriminatory hostile work environment should have survived dismissal after he presented evidence that supervisors repeatedly made demeaning comments to him tied to his race, age and disability, a state appeals court has ruled.

But Sidney Sims’ related state and city Human Rights Laws claims for retaliation and discrimination were rightfully dismissed by a lower court, ruled an Appellate Division, First Department panel, because he failed to link complained-of behavior to race, age or disability bias and because certain actions did not amount to adverse action against him.
