Boasberg included a color photograph of a waterfall. But the waterfall metaphor, he acknowledged, does not provide a clear picture of how the trusts are structured.

He suggested a different image: a champagne tower.

“The proper metaphor would instead be a champagne tower, where the bottom investors are left thirsty until those above are filled with bubbly,” he wrote in text above a photograph of champagne flowing into a pyramid of glasses.

Boasberg told the SEC to go back and talk with the IRS about the settlement-distribution plan before presenting it again to the court.
