The U.S. Court of Appeals for the Fourth Circuit has revived a civil rights lawsuit accusing a North Carolina school district of student-on-student racial harassment and school board retaliation.

A former student represented by Latham & Watkins “sufficiently alleged she suffered racial harassment that was so severe, pervasive, and objectively offensive that it deprived her of equal access to the educational opportunities or benefits provided by [William G. Enloe High School],” Judge Roger L. Gregory wrote in the opinion for the Fourth Circuit filed Tuesday.
