U.S. Solicitor General Elizabeth Prelogar said Friday that there has been “a real shift” toward the Supreme Court’s emergency docket in recent years, acknowledging her office’s frequent participation in disputes about emergency applications and other requests for extraordinary relief.

Prelogar, who has served as the Biden administration’s top U.S. Supreme Court lawyer since 2021, said the rise of the emergency docket—sometimes called the shadow docket—has “really changed the nature of the work in the office” over the last decade.
