Three Republican-appointed judges grilled lawyers with the U.S. Food and Drug Administration and drugmaker Danco Laboratories during oral arguments Wednesday in a challenge to the agency’s approval of the abortion pill mifepristone and expansion of access to it.

Judge James Ho, appointed by former President Donald Trump, strongly questioned the FDA and Danco’s position that courts shouldn’t second guess the agency’s science-backed decisions on drug approvals. He characterized their position as boiling down to the FDA is infallible and pushed back against their describing the lawsuit as unprecedented.
