The Department of Justice said former President Donald Trump should not get executive immunity from liability claims filed by those injured during the Jan. 6, 2021, attack on the Capitol in a new filing Thursday.

“Although courts should be reluctant to conclude that a suit against the President is based on conduct that lies beyond the outer perimeter of his office, the United States agrees with the district court that a meaningful perimeter exists,” wrote DOJ Principal Deputy Assistant Attorney General Brian Boynton in the brief submitted after oral arguments were heard in the dispute late last year.
