Attorneys for Steve Bannon, a former top adviser to former President Donald Trump, asked a judge on Monday to force prosecutors to turn over records related to the U.S. Justice Department’s decision not to charge two former top Trump aides with contempt of Congress.

Bannon’s lawyers said the materials on former Chief of Staff Mark Meadows and Deputy Chief of Staff Dan Scavino Jr. are “directly relevant” to the defense theory of his case. His attorneys have argued that protections for executive privilege, and by extension immunity from prosecution when executive privilege is invoked, extend to current and former government officials and private citizens who are subpoenaed by Congress.
