U.S. Court of Appeals for the Fifth Circuit Judge James Ho, in a speech Tuesday to a Federalist Society chapter in Florida, warned his colleagues on the bench against ruling a certain way only so that “elites won’t be upset with you.”

The Trump-appointed judge tied his own term, “fair-weather originalism,” to jurists who he said only follow originalism, a legal philosophy championed by conservatives, when it doesn’t upset “the elites” and people with a “hatred of the Constitution.”
