A Florida man accused of storming the Capitol on Jan. 6 plans to use a “public authority” defense, claiming that former President Donald Trump gave permission for the mob’s actions, his lawyer said in a new court filing.

The man, Gabriel Garcia, will argue that he relied on Trump’s statements at a rally preceding the riot, during which Trump urged his supporters to march to the Capitol, when Garcia joined the mob that breached the building, his lawyers, Aubrey Webb and Charles Haskell said.
