The U.S. Justice Department took heat this year from supporters of the Biden administration for continuing controversial Trump-era legal stances.

The Biden DOJ, for example, maintained the department’s defense of former President Donald Trump in a defamation case brought by a journalist whom Trump criticized after she accused him of a decades-old sexual assault. DOJ attorneys had concluded that Trump was acting in his official capacity in responding to the allegations, meaning the department was legally required to represent him.
