One of President Joe Biden’s picks for the U.S. Court of Appeals for the Ninth Circuit, Jennifer Sung, hit a roadblock Thursday when the Senate Judiciary Committee deadlocked over her nomination.

The panel split 10-10 along party lines in a vote that followed repeated objections from GOP senators, making Sung the first judicial pick under Biden who has failed to advance favorably out of the committee. Democratic Senate Majority Leader Chuck Schumer could call for a motion to discharge Sung’s nomination from the committee, which would require a full Senate vote.
