Donald Trump might soon be back in court to fight the release of documents as part of a congressional Jan. 6 investigation. But legal experts say he may face an uphill battle in keeping that information secret.

As president, Trump repeatedly invoked executive privilege to block the release of information sought by congressional Democrats, including Special Counsel Robert Mueller III’s full report, former White House counsel Don McGahn’s testimony, and information about the attempt to include a citizenship question on the 2020 census. Now the papers being sought are under the control of the Biden administration, leaving it up to current White House lawyers to determine whether they should be shielded from Congress.
