The U.S. Court of Appeals for the Federal Circuit ruled Monday that U.S. District Judge Alan Albright clearly abused his discretion when he refused to transfer SITO Mobile R&D IP LLC’s patent infringement action against the Santa Monica, California-based Hulu to the Central District of California.

Many other tech companies are making similar arguments as they try to get out of the Western District of Texas, where Albright is presiding over about 25% of the nation’s patent infringement cases. Albright has established speedy and plaintiff-friendly pretrial procedures that have drawn non-practicing entities to Waco, Texas. Although Waco jurors have returned several defense verdicts in patent cases, one awarded $2.175 billion against Intel Corp. in February.
