A man photographed on the Senate floor with a Trump 2020 campaign flag during the Jan. 6 riot in the U.S. Capitol will spend eight months in prison, a sentence that a federal judge said will be lenient compared to what others face for their role in the violence that day.

U.S. District Judge Randolph Moss of the District of Columbia opted to depart from the federal sentencing guidelines and sentence Paul Hodgkins, a 38-year-old Tampa, Florida, resident, to eight months in prison with two years of supervised release. Federal prosecutors had asked for an 18-month sentence, the midpoint of the 15-to-21-month range called for by the sentencing guidelines.
