Three U.S. Supreme Court justices criticized their colleagues for failing to do the “hard work” of digging into an excessive force claim revived Monday against a metropolitan police department.

Justice Samuel Alito Jr., joined by Justices Clarence Thomas and Neil Gorsuch, dissented from an unsigned opinion that vacated and remanded a decision by the U.S. Court of Appeals for the Eighth Circuit that police did not use unconstitutionally excessive force against a prisoner who was attempting suicide.
