A federal judge in California said Friday that she would agree to a temporary stay in a lawsuit about the 2020 census, but not without an enforceable court order in place, pointing to prior changes in the stance of the Justice Department in the case.

In a joint case management statement filed Friday, DOJ attorneys said the administration would agree to not release any new reports or numbers tied to the decennial census for 21 days, as the Trump administration exits and Biden officials take over. The statement, which was also agreed to by lawyers for the plaintiffs, said the pause would “provide for an orderly transition and to let the new administration assess the case.” If any new numbers or reports are released, officials would give the opposing attorneys seven days notice.
