A litigation finance firm claims that defunct plaintiffs firm Girardi Keese owes more than $10 million, while the brother of the firm’s founder, Tom Girardi, says his sibling is “not capable of making rational decisions” and has asked a bankruptcy judge to appoint him to speak on Girardi’s behalf.

The lender, identified as Virage SPV 1 LLC, filed the disclosure Tuesday in U.S. bankruptcy court and is the third lender to claim Girardi Keese owes millions of dollars in loan payments. Other creditors filed involuntary Chapter 7 bankruptcy petitions last month against Girardi and his firm, both of which also face a $2 million contempt judgment for failing to pay clients from settlements with Boeing over the 2018 crash of Lion Air Flight 610 in Indonesia.
