As Congress considers measures to hold President Donald Trump accountable for last week’s deadly insurrection at the U.S. Capitol by his supporters, historians and legal scholars are putting a new spotlight on a long-ago and seldom-used section of the U.S. Constitution.

Under the terms of Civil War-era Section 3 of the 14th Amendment, Trump could be barred from ever holding federal office again if he is found by Congress to have “engaged in insurrection or rebellion against” the U.S. Constitution. Some advocates contend Section 3 provides a clearer path for Democrats to rebuke Trump and stop him from any pursuit of the presidency in 2024.
