The Archdiocese of Washington hired a team of Jones Day attorneys, including former White House counsel Don McGahn, to sue Washington, D.C., over its new pandemic restrictions for religious institutions.

The lawsuit, filed Dec. 11 in the U.S. District Court for the District of Columbia, alleges D.C.’s new hard cap for 50 people at houses of worship—implemented late last month as COVID cases rise in the region—is unconstitutional, as it unfairly targets religious institutions while other places like restaurants, libraries and gyms aren’t subject to caps.
