A three-judge panel on the U.S. Court of Appeals for the D.C. Circuit signaled Tuesday that it will rule on the House’s longstanding bid to obtain President Donald Trump’s tax records without sending it back to a lower court.

Tuesday’s arguments on the subpoena to Mazars was the second time the panel has heard the case, after the U.S. Supreme Court in July set a test on congressional subpoenas to third parties for a president’s personal papers and remanded the issue to lower courts. Trump’s legal team at Consovoy McCarthy has urged the D.C. Circuit to send the case back to the trial court in order to consider new legal issues, while House lawyers seek a swift resolution at the appellate level.
