The Consumer Financial Protection Bureau is unconstitutionally structured and lacks authority to bring claims, U.S. District Senior Judge Loretta Preska of the Southern District of New York ruled on Thursday, departing from an en banc ruling by the U.S. Court of Appeals for the D.C. Circuit earlier this year.

Preska’s decision, announced at the end of a 104-page order, halted enforcement efforts by the CFPB in cases over litigation funding impacting 9/11 victims and NFL concussion claimants.
