Any data expert will tell you that implementing an information governance (IG) strategy can be a slow, yearslong process, fraught with false starts and realignments. But nowhere is IG more challenging than in mergers and acquisitions (M&As), and, given the potential for increased e-discovery, cybersecurity and compliance issues, these restructures can create a host of problems for a parent organization and its counsel.

One of the biggest IG challenges during an M&A, says FTI senior managing director Jake Frazier, is that your progress can come to halt, leaving the sense that your organization has to “start all over … because a whole new set of variables got dropped on your end.”
