Experts are split on whether 2025 will see gen AI become a staple in e-discovery—boosted by the case law and processes already in place for technology assisted review (TAR)—or struggle to gain traction because of its potential high costs, risks and immaturity as an emerging technology.

Where gen AI may have a more immediate impact, however, is creating more discoverable content, with some predicting that the data from AI assistants could soon face preservation and production requests.
