A federal appeals court panel appeared skeptical of claims that drivers’ privacy rights were violated when lawyers obtained their accident reports in order to solicit them for marketing purposes.
“It doesn’t seem the information you have here was obtained from any DMV records,” said Judge Harvie Wilkinson of the U.S. Court of Appeals for the Fourth Circuit on Tuesday morning. The drivers claimed the Driver’s Privacy Protection Act should limit lawyers’ ability to collect information from accident reports.
