In-house lawyers, quite rightly, have a rather jaundiced view of elements of the commercial litigation experience. Comments such as 'not enough judicial intervention', 'pointless trench warfare', 'solicitors don't speak to each other' and 'we paid a small fortune to find a mountain of documents which no one looked at' are not uncommon. To remedy these problems various initiatives have been set up, including the piloting of the recommendations of the Commercial Court Long Trials Working Party.
