As of 6 April, defendants making offers to settle under part 36 will no longer have to pay into court. Most practitioners will be aware of this, but how did this major change come about?
The initial debate was prompted by two Court of Appeal decisions. The first was Crouch v King’s Healthcare NHS Trust, in which it was accepted that it was better for the NHS to retain funds for providing public services than to pay into court.
