The claimants in Independiente and others v Music Trading Online (HK) [2006] are major figures in the music industry. The defendant, Music Trading Online, sells CDs and DVDs worldwide through its website.
The claimants had originally brought proceedings in the English and Irish courts against the defendant in 2002, complaining that Music Trading was infringing their copyright and parallel importing music products into the European Economic Area (EEA).
