Denton Wilde Sapte has secured a significant Court of Appeal victory for the British Horseracing Board (BHB) in relation to its ability to charge fees for ‘pre-race’ information on horses and riders.
The Court last week overturned a December 2005 High Court finding that the BHB had abused its dominant position by charging excessive fees for pre-race information to Attheraces (ATR), a racing consortium comprised of BSkyB and Arena Leisure. ATR is a UK horseracing broadcaster which relies on the data for its service to bookmakers.
