The Law Society has reacted with alarm to Government plans that could deny defendants in criminal fraud cases the right to choose their own solicitor.
A consultation paper released over the summer by the Department for Constitutional Affairs proposes that judges should decide if there is a potential conflict when several defendants are represented by the same solicitor in some serious criminal cases. Judges would also be able to remove solicitors who they deem too busy to represent defendants.
