The recent health and safety prosecution of Southampton University Hospitals Trust highlights the potential for investigations into management systems, including clinical failures within the healthcare sector.

The conviction of the healthcare trust at Winchester Crown Court on 11 April for serious health and safety failings has been widely – and often inaccurately – reported. The trust was fined £100,000 for breaching its general duty under Section 3 of the Health and Safety at Work Act 1974 (HSWA) to protect non-employees and others against healthy and safety risks.
