The European Court of Justice (ECJ) has delivered its judgment on the referral under Article 234 of the EC Treaty by the Irish Supreme Court in the case of Euro-food IFSC Limited (In Liquidation), the Irish Parmalat subsidiary.

The referral arose from a dispute between the Irish and Italian courts on the interpretation of the European Insolvency Regulation on 2 May, 2006. The ECJ endorsed the decision of the Irish High Court and Advocate General Jacobs’ opinion and confirmed the Irish order winding up Eurofood and the appointment of Mr Pearse Farrell as official liquidator of Eurofood.
