Dyson v Qualtex (UK) [2006] is the first Court of Appeal decision to consider the scope of protection given to spare parts by UK unregistered design right (UDR) under the 1988 Copyright, Designs and Patents Act (CDPA).
The Court of Appeal ruling that Dyson’s spare parts could not be copied and were protected by the UK’s unregistered design right regime has profound implications for the whole UK spare parts industry. It will be warmly welcomed by original equipment manufacturers (OEMs) throughout the UK.
