Senior litigators have cited the growing culture of early settlement and insufficient investment for the current slump in ‘red-meat’ City litigation as figures released this month show the number of cases heard at the Commercial Court has hit a five-year low.

The Commercial Court’s annual report confirmed that London’s flagship court has seen cases fall from the 81 heard in the previous 12 months to just 58. One hundred and sixty-four cases settled or were adjourned last year, out of the 222 that were given trial dates.
