On 1 October, 2004, statutory minimum procedures on disciplinary and grievance matters will be introduced. The minimum disciplinary procedures apply where dismissal or other disciplinary action is contemplated short of dismissal, but this excludes oral or written warnings or suspension with pay. A grievance is defined as a complaint by an employee about action which his employer has taken or is contemplating taking in relation to him.

The rules and procedures are set out in the Employment Act 2002 and the Employment Act 2002 (Dispute Resolution) Regulations 2004. In using the minimum disciplinary and grievance procedures, there are circumstances where the procedure does not apply or does not need to be completed.
