UK lawyers are predicting a potential surge in cross-border litigation following a high level opinion from the European Court of Justice (ECJ) which could allow ‘jurisdiction shopping’ across the European Union (EU).
The news follows an opinion from ECJ advocate general, Ruiz-Jarabo Colomer, that finds that one EU state’s court cannot prevent litigants continuing action in other member states if they fail at the initial attempt.
