In the past 10 years, the system of commercial dispute resolution in Russia has attracted considerable criticism both domestically and abroad.

Litigating in the Russian courts was widely considered to be so ineffective as to amount to a waste of time. Domestic arbitration was virtually non-existent and international arbitration was considered ineffective due to lack of support from the state courts. Mediation and other alternative dispute resolution mechanisms were non-existent and the legal profession was regarded by many as being in its infancy.
