Sherry BegnorOne of the key areas in which the introduction of the Civil Procedure Rules (CPR) has changed the litigation landscape has been expert evidence. Aside from giving the court a more active role in managing its use, CPR Part 35 also sets out the general requirements in respect of the form and content of the expert’s evidence and provides a framework for the appointment of the expert.

The Academy of Experts and the Expert Witness Institute have each produced a code of guidance for experts and those instructing them. The guidance is comprehensive and, in both cases, cross-refers to the relevant sections of the CPR.
