The House of Lords has unanimously rejected the reasoning of the Court of Appeal in the somewhat notorious decision in Brocklesby v Armitage and Guest [1999] relating to the postponement of limitation periods.
Professionals and their indemnity insurers can breathe a collective sigh of relief that the pre-Brocklesby status quo has been restored by this decision, which was handed down in April.
