Are the proverbial turkeys voting for Christmas? The casual observer of divorce law could be forgiven for jumping to such a conclusion given the warm welcome that has greeted last week's much-touted Supreme Court ruling, Radmacher v Granatino. After all, the judgment has for the first time explicitly recognised the enforceability of prenuptial agreements, a landmark ruling given the traditional resistance of the judiciary in England and Wales to such contracts. And on the face of it, allowing prenups to stand could be expected to reverse the English courts' oft-claimed reputation as the divorce capital of the world.
