A suit alleging a natural gas drilling operation violated the Clean Air Act has survived a motion to dismiss in federal court and raised novel questions about abstention.
An environmental group called Citizens for Pennsylvania’s Future brought the suit against Ultra Resources, claiming that the company skirted state regulations by applying for separate permits for each of the seven facilities it planned to build rather than pursuing a permit that would have considered the operation as whole, which is a more onerous process.
