Because the district court judge didn’t review videos depicting violent sex acts perpetrated on children before letting the jury see them, he abused his discretion and allowed the potential for the jury to be prejudiced, the U.S. Court of Appeals for the Third Circuit ruled this week. As a result, David Cunningham, who was convicted on charges related to the distribution of child pornography in 2010, is going to get a new trial.

Cunningham had been sentenced to 17 1/2 years in prison after he was convicted of three charges related to the distribution of child pornography.
