U.S. District Senior Judge Robert F. Kelly of the Eastern District of Pennsylvania held that TruePosition, which brought the action, satisfied the requirements to bring a Section 1 Sherman Act violation suit after it filed an amended complaint. It made extensive allegations drawn from years of internal dealings at an organization that sets the standards for the cellphone industry. The antitrust suit targets the standard-setting organization and several participating cellphone companies.
