The Lackawanna County guardian ad litem has asked a federal judge to dismiss a lawsuit filed against her, arguing she is entitled to judicial immunity and that the federal court lacks subject-matter jurisdiction over issues stemming from a state custody case.

The lawsuit also named Lackawanna County and the county’s common pleas court as defendants. In another filing earlier this month, the court system asked the U.S. District Court for the Middle District of Pennsylvania to dismiss it from the matter, asserting 11th Amendment immunity.
