Samuel Stretton, in a recent article dealing with lawyers’ efforts to collect unpaid fees (Ethics Forum, July 26, Pennsylvania Law Weekly ), discussed using the criminal process, including in his analysis the following: “A lawyer can threaten criminal prosecution such as a private criminal complaint for theft of services. Clearly, if a lawyer is retained and performs the work, and the client promises to pay and the client doesn’t, there is a theft that is taking place.”
