In a ransom situation following a cyber attack, should you ever pay what’s being demanded? Lawyers at Freshfields Bruckhaus Deringer say doing so can sometimes work out well. But, conversely, you don’t want to end up on “the sucker’s list”.

Rhodri Thomas, a disputes partner at Freshfields Bruckhaus Deringer said sometimes a company under attack may choose to pay out a ransom following a cyber attack, despite regulators urging the opposite, amongst a hazy legal framework. “Most clients won’t end up paying the ransom but in my experience, when they do they have [sometimes] been successful,” he said.
